Please read these Terms of Service (“Terms”) carefully before using Aphivia (the “Service”) operated by Aphivia (“we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use Aphivia. By using the Service, you represent and warrant that you meet this age requirement, that you have the legal capacity to enter into these Terms, and that your use of the Service does not violate any applicable laws or regulations.

2. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. Notify us immediately at support@aphivia.com if you suspect any unauthorized use of your account.

You may not create more than one account per person.

3. The Rewards Platform

Aphivia provides a platform where users can earn points by completing qualifying offers (such as surveys, app installs, free trials, and sign-ups) made available through our third-party offerwall partner. Points accumulated in your account may be redeemable for rewards as described on the Service.

  • Points have no monetary value and are not transferable to other accounts.
  • We reserve the right to adjust the point value of any offer at any time.
  • Points may expire or be forfeited if your account is inactive for an extended period or if your account is terminated for violations of these Terms.
  • We are not responsible for technical issues with third-party offers that prevent points from being credited.

4. Prohibited Conduct

You agree not to:

  • Create multiple accounts or use automated tools, bots, or scripts to complete offers
  • Provide false, misleading, or fraudulent information to complete offers or earn points
  • Attempt to manipulate, hack, or exploit any feature of the Service or its underlying systems
  • Reverse engineer or attempt to extract the source code of the Service
  • Use the Service in any way that violates applicable laws, including without limitation those related to privacy, advertising, and consumer protection
  • Harass, threaten, or harm other users or our staff
  • Post or transmit any content that is unlawful, defamatory, or obscene
  • Circumvent or interfere with any security features or access controls of the Service

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Aphivia and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6. Third-Party Services

The Service integrates third-party offers, advertising, and analytics services. Your interactions with those third parties are governed by their own terms and privacy policies. We are not responsible for the content, accuracy, or practices of third-party services.

7. Advertising

We display advertisements through Google AdSense and other advertising partners. By using the Service, you acknowledge that we may display such advertisements and that your data may be used by advertising partners in accordance with their own privacy policies.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APHIVIA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $10 USD.

10. Termination

We may suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the integrity of the Service. Upon termination, any accumulated points are forfeited.

You may close your account at any time by contacting us at support@aphivia.com.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the effective date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
